Introduction
Intellovations LLC, conducting business as ForecastWatch (“ForecastWatch,” “we,” “us,” or “our”), respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy describes how we collect, use, disclose, and safeguard your information when you visit our website at www.forecastwatch.com (the “Website”), use our software-as-a-service platform, forecast verification analytics, data products, APIs, or other services (collectively with the Website, the “Services”), or otherwise interact with us.
Please read this Privacy Policy carefully. By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not access or use the Services.
This Privacy Policy is incorporated into and subject to our Terms of Use, available at /terms on the ForecastWatch platform.
1. Information We Collect
We collect information in several ways depending on how you interact with our Services.
1.1 Information You Provide Directly
We collect information that you voluntarily provide to us, including when you register for an account, subscribe to our Services, request a demo, fill out a form, make a purchase, contact our support team, or otherwise communicate with us. This information may include: your name; email address; telephone number; company name, title, and business address; billing and payment information (such as credit card numbers or bank account details); login credentials (username and password); and any other information you choose to provide in correspondence, support requests, or user-generated content.
1.2 Information Collected Automatically
When you access or use the Services, we automatically collect certain information about your device and usage, including: IP address; browser type and version; operating system; device type and identifiers; referring and exit URLs; pages viewed, links clicked, and features used within the Services; date, time, and duration of your visits; and general geographic location inferred from your IP address.
1.3 Cookies and Similar Technologies
We use cookies, web beacons, pixels, and similar tracking technologies to collect information about your browsing activity, personalize your experience, analyze usage trends, and administer the Website. Cookies are small data files stored on your device. You can control cookies through your browser settings; however, disabling cookies may limit your ability to use certain features of the Services. We use the following categories of cookies:
- Strictly necessary cookies, which are required for the Website to function.
- Performance and analytics cookies, which help us understand how visitors interact with the Website.
- Functionality cookies, which remember your preferences and settings.
- Advertising and targeting cookies, which may be used to deliver relevant content or measure campaign effectiveness.

1.4 Information from Third Parties
We may receive information about you from third-party sources, including business partners, marketing partners, data providers, publicly available sources, and social media platforms. We may combine this information with other information we hold about you.
1.5 Customer Data and Customer Forecast Data
Our customers (“Customers”) may submit two distinct categories of data to the Services in the course of using them.
(a) Customer Data. This includes personal data and other information submitted by a Customer about its own personnel, contractors, end users, or other individuals (for example, account information for the Customer’s authorized users). ForecastWatch processes such Customer Data on behalf of the Customer in accordance with our Terms of Use, the applicable Order Form, and any Data Processing Addendum. We do not control the content of Customer Data and do not use it except as authorized by the Customer or as required by law. If you are an end user of one of our Customers and have questions about how your personal information is handled, please contact the Customer directly.
(b) Customer Forecast Data. This includes worldwide point-specific forecast data, observations, and related meteorological data submitted or contributed by Customers for verification, scoring, comparison, or analysis. Customer Forecast Data is generally not personal information. We have a broad, perpetual license to use Customer Forecast Data for any lawful purpose, subject to two commitments: (i) we do not display Customer Forecast Data to other customers or to third parties in a manner that specifically identifies the contributing Customer as the source, and (ii) we do not use Customer Forecast Data to produce a weather forecast product that directly competes with the contributing Customer’s weather forecast products. ForecastWatch owns the aggregated and derived outputs computed from Customer Forecast Data. The full terms of this license are set out in Section 3.3 of the Terms of Use.
2. How We Use Your Information
We use the information we collect for the following purposes:
- Providing and maintaining the Services — to create and manage your account, process transactions, deliver the Services, provide customer support, and communicate with you about your account or subscription.
- Improving and developing the Services — to analyze usage patterns, diagnose technical issues, conduct research and development, and improve the functionality, performance, and security of the Services.
- Personalization — to tailor content, features, and recommendations to your interests and preferences.
- Marketing and communications — to send you promotional materials, newsletters, product updates, and other marketing communications that may be of interest to you. You may opt out of marketing communications at any time (see Section 8).
- Analytics and aggregation — to generate aggregated, de-identified, or anonymized data and insights that do not personally identify you, which we may use for any lawful purpose, including benchmarking, research, industry reporting, and marketing.
- Legal compliance and protection — to comply with applicable legal obligations; to enforce our Terms of Use and other agreements; to protect the rights, property, or safety of ForecastWatch, our Customers, or others; and to detect, prevent, or address fraud, security, or technical issues.
- Business operations — to manage our business, including billing, accounting, auditing, and internal administration.
3. How We Share Your Information
We do not sell your personal information. We may share your information in the following circumstances.
3.1 Service Providers
We share information with third-party vendors, consultants, and service providers who perform services on our behalf, such as payment processing, data hosting, email delivery, analytics, customer support, and marketing. These service providers are contractually obligated to use your information only as necessary to perform services for us and in a manner consistent with this Privacy Policy. A current list of our material sub-processors is available upon request to support@forecastwatch.com. We will use commercially reasonable efforts to notify Customers of material changes to our sub-processor list.
3.2 Business Transfers
If ForecastWatch is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of its assets, your information may be transferred as part of that transaction. We will notify you via email or prominent notice on the Website of any change in ownership or uses of your personal information.
3.3 Legal Requirements
We may disclose your information if required to do so by law, regulation, legal process, or governmental request, or if we believe in good faith that disclosure is necessary to: (a) comply with a legal obligation; (b) protect and defend the rights or property of ForecastWatch; (c) prevent or investigate possible wrongdoing in connection with the Services; (d) protect the personal safety of users of the Services or the public; or (e) protect against legal liability.
3.4 With Your Consent
We may share your information with third parties when you have given us your express consent to do so.
3.5 Aggregated and De-Identified Data
We may share aggregated, de-identified, or anonymized information that cannot reasonably be used to identify you with third parties for any lawful purpose, including research, analytics, benchmarking, and marketing.
3.6 Affiliates
We may share your information with our corporate affiliates and subsidiaries for purposes consistent with this Privacy Policy.
4. Data Retention
We retain your personal information for as long as reasonably necessary to fulfill the purposes for which it was collected, to provide the Services, to comply with our legal obligations, to resolve disputes, and to enforce our agreements. The specific retention period depends on the nature of the information and the context in which it was collected. When personal information is no longer needed for any of these purposes, we will delete or de-identify it in accordance with our data retention practices.
- Account information is generally retained for as long as your account remains active and for a reasonable period thereafter.
- Billing records are retained as required by applicable tax and financial regulations.
- Automatically collected usage data is typically retained in identifiable form for no more than twenty-four (24) months.
- Customer Data retention and post-termination handling are governed by our Terms of Use. ForecastWatch will use commercially reasonable efforts to delete Customer Data from active systems within ninety (90) days of termination, except as required by law or for legitimate archival, backup, or audit purposes.
- Customer Forecast Data is retained as needed to provide the Services to the contributing Customer until the forecast valid date passes. Once the date has passed (as Verified Customer Forecast Data), it may be retained indefinitely as part of our historical forecast record for analytics, benchmarking, research, and the other purposes set out in Section 3.3 of the Terms of Use, always subject to the source-masking commitment described in Section 1.5(b) above.
5. Data Security
We implement commercially reasonable administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, use, alteration, and destruction. These measures include encryption of data in transit and at rest, access controls, regular security assessments, and employee training. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.
Security incident notification. In the event of a security incident affecting your personal data, ForecastWatch will notify affected Customers without undue delay, and in any event within seventy-two (72) hours, after becoming aware of the incident, to the extent required by applicable law.
6. Children’s Privacy
The Services are intended for business users and are not directed to individuals under the age of eighteen (18). We do not knowingly collect personal information from individuals under 18. If we become aware that we have collected personal information from an individual under 18, we will take steps to delete such information promptly. If you believe that we have inadvertently collected information from an individual under 18, please contact us at support@forecastwatch.com.
7. Third-Party Links and Services
The Services may contain links to third-party websites, services, or applications that are not operated or controlled by ForecastWatch. This Privacy Policy does not apply to any third-party services. We encourage you to review the privacy policies of any third-party services you access. We are not responsible for the privacy practices or content of any third-party services.
8. Your Choices and Rights
8.1 Marketing Communications
You may opt out of receiving promotional emails from us by following the unsubscribe instructions included in each email or by contacting us at support@forecastwatch.com. Even if you opt out of marketing communications, we may still send you transactional or service-related communications, such as account notifications, billing reminders, and security alerts.
8.2 Cookies
Most web browsers are set to accept cookies by default. You can adjust your browser settings to remove or reject cookies. You may also use browser-based opt-out mechanisms or industry tools such as the Digital Advertising Alliance’s opt-out page (www.aboutads.info/choices) or the Network Advertising Initiative’s opt-out page (www.networkadvertising.org/choices). Please note that removing or rejecting cookies may affect the functionality of the Services.
8.3 Do Not Track
Some browsers offer a “Do Not Track” (“DNT”) signal. Because there is no accepted standard for how to respond to DNT signals, the Website does not currently respond to DNT signals. We will continue to monitor developments around DNT browser technology and update our practices as appropriate.
8.4 Account Information
You may update, correct, or delete your account information at any time by logging into your account or by contacting us at support@forecastwatch.com. Please note that we may retain certain information as required by law or for legitimate business purposes, and some information may persist in backup copies for a reasonable period.
9. State-Specific Privacy Rights
9.1 California Residents — CCPA/CPRA
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA”), provides you with additional rights regarding your personal information.
Categories of personal information collected. In the preceding twelve (12) months, we have collected the following categories of personal information: identifiers (such as name, email address, IP address); commercial information (such as transaction history and subscription details); internet or electronic network activity information (such as browsing history, search history, and interaction with the Services); geolocation data (inferred from IP address); and professional or employment-related information (such as company name and job title).
Sources. We collect personal information from the sources described in Section 1 of this Privacy Policy.
Business purposes. We use personal information for the business purposes described in Section 2 of this Privacy Policy.
Disclosure. We disclose personal information to the categories of third parties described in Section 3 of this Privacy Policy.
Sale and sharing. We do not “sell” or “share” (as those terms are defined under the CCPA/CPRA) your personal information for monetary or other valuable consideration.
Your California privacy rights. Subject to certain exceptions, California residents have the right to: (a) know what personal information we have collected, used, disclosed, and sold about you; (b) request deletion of your personal information; (c) correct inaccurate personal information; (d) opt out of the sale or sharing of personal information (though we do not sell or share your information); and (e) not be discriminated against for exercising your privacy rights. To submit a request, please contact us at support@forecastwatch.com. We will verify your identity before processing your request. You may designate an authorized agent to make a request on your behalf.
Service provider role. When ForecastWatch processes personal information of a Customer’s end users on the Customer’s behalf, we act as a “service provider” under the CCPA/CPRA. End users seeking to exercise CCPA/CPRA rights with respect to such personal information should direct their requests to the applicable Customer, who is the “business” responsible for that personal information.
Statutory exceptions. Some requests may be subject to verification and to exceptions permitted under the CCPA/CPRA, including where retention or disclosure is necessary to: complete a transaction; detect, protect against, or prosecute security incidents or fraud; comply with a legal obligation; or use the information internally in a manner reasonably aligned with the consumer’s expectations and the context in which it was provided.
Sensitive personal information. We do not collect or process sensitive personal information as defined under the CCPA/CPRA for purposes other than those permitted by law.
9.2 Virginia Residents — VCDPA
If you are a Virginia resident, the Virginia Consumer Data Protection Act (“VCDPA”) provides you with certain rights, including the right to access, correct, delete, and obtain a copy of your personal data, as well as the right to opt out of the processing of personal data for targeted advertising, the sale of personal data, and profiling in furtherance of decisions that produce legal or similarly significant effects. To exercise these rights, please contact us at support@forecastwatch.com. If we decline your request, you have the right to appeal by contacting us.
9.3 Colorado Residents — CPA
If you are a Colorado resident, the Colorado Privacy Act (“CPA”) provides you with rights similar to those described in Section 9.2. To exercise your rights, please contact us at support@forecastwatch.com.
9.4 Connecticut Residents — CTDPA
If you are a Connecticut resident, the Connecticut Data Privacy Act (“CTDPA”) provides you with rights similar to those described in Section 9.2. To exercise your rights, please contact us at support@forecastwatch.com.
9.5 Utah Residents — UCPA
If you are a Utah resident, the Utah Consumer Privacy Act (“UCPA”) provides you with the right to access, delete, and obtain a copy of your personal data, and to opt out of the sale of personal data and targeted advertising. To exercise your rights, please contact us at support@forecastwatch.com.
9.6 Texas Residents — TDPSA
If you are a Texas resident, the Texas Data Privacy and Security Act (“TDPSA”) provides you with rights similar to those described in Section 9.2, including the right to access, correct, delete, and obtain a portable copy of your personal data, and to opt out of targeted advertising, the sale of personal data, and certain profiling. 9.7 Other State Privacy Laws
Additional states have enacted or may enact consumer privacy legislation. If you are a resident of a state with an applicable consumer privacy law not specifically addressed above, you may contact us at support@forecastwatch.com to inquire about exercising your rights under applicable law.
10. International Users
The Services are operated from the United States. If you access the Services from outside the United States, please be aware that your information may be transferred to, stored in, and processed in the United States, where data protection laws may differ from those in your country of residence. By using the Services, you consent to the transfer of your information to the United States and the processing of your information in accordance with this Privacy Policy.
EEA, UK, and Switzerland. If you are located in the European Economic Area (“EEA”), the United Kingdom (“UK”), or Switzerland, we rely on appropriate legal bases for transferring your personal data to the United States, including:
- the Standard Contractual Clauses adopted by the European Commission for transfers of personal data to third countries;
- the UK International Data Transfer Addendum (or its predecessor mechanism) for transfers from the United Kingdom; and
- equivalent transfer mechanisms recognized by the Swiss Federal Data Protection and Information Commissioner.
Customers subject to the EU GDPR, UK GDPR, or Swiss FADP may request a Data Processing Addendum (“DPA”) from ForecastWatch by emailing support@forecastwatch.com. The DPA, once executed, will govern ForecastWatch’s processing of personal data on the Customer’s behalf and incorporate appropriate transfer mechanisms.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. When we make material changes, we will notify you by posting the updated Privacy Policy on the Website and updating the “Effective Date” at the top of this page. We may also provide notice through email or a prominent notice within the Services. We encourage you to review this Privacy Policy periodically. Your continued use of the Services after the posting of a revised Privacy Policy constitutes your acceptance of the changes.
